On January 20, 2025, President Trump issued a proclamation amending the birthright citizenship policy of the United States. This is a great day for our country. Speaking only for myself, I think the proclamation is not only good policy but also good law on a proper reading of the Fourteenth Amendment. The president’s order should be welcomed by all patriots and constitutional originalists, and even by its critics, many of whom rightly point out that it gives the Supreme Court an opportunity to revisit the issue. Good. Let’s have that debate. As I’ve written elsewhere, I think executive action to curtail birthright citizenship is fully compliant with the Constitution.
